Terms of Use
e-Flow Merchant Group
Effective Date: October 10, 2026
Last Updated: October 10, 2026
1. Acceptance of These Terms
These Terms of Use ("Terms") govern your access to and use of eflowmerchgroup.com (the "Site"), operated by e-Flow Merchant Group ("e-Flow," "we," "us," or "our").
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
If you are using the Site on behalf of a business or other entity, you represent that you have authority to bind that entity, and "you" refers to that entity.
2. What e-Flow Does — and What It Does Not Do
e-Flow Merchant Group is an independent sales and referral agent for payment processing services. We help businesses evaluate what they are paying to accept credit and debit cards, and we connect them with payment processing providers.
Please understand the following, which is material to anything else on this Site:
- e-Flow is not a bank, and is not a payment processor. We do not acquire, authorize, settle, or fund card transactions. We do not hold merchant funds at any time.
- Payment processing services are provided by third parties, including our processing partners and their sponsoring financial institutions, under separate written agreements between you and those parties.
- We do not approve merchant accounts. All merchant account applications are subject to underwriting, approval, and the terms and conditions of the processor and its sponsoring bank. We have no authority to guarantee approval, pricing, or timelines.
- Any rates, fees, or program terms we discuss become binding only when set out in a written agreement signed by you and the applicable processor. Nothing on this Site, and no proposal, quote, analysis, or communication from e-Flow, constitutes a binding offer or a contract for processing services.
3. No Financial, Legal, Tax, or Compliance Advice
Information on this Site, and any analysis, proposal, or guidance we provide, is offered for general informational purposes only. It is not financial, legal, accounting, tax, or regulatory compliance advice, and should not be relied upon as such.
This applies with particular force to any discussion of surcharging, cash discount programs, dual pricing, interchange optimization, or payment card industry rules. These areas are governed by card network operating rules, federal law, and state laws that differ by jurisdiction and change frequently. Whether any particular program is permissible for your business, in your state, and as you intend to implement it, is a question you should put to your own attorney and accountant before you adopt it.
You are solely responsible for your business's compliance with all applicable laws, regulations, and card network rules, including those governing pricing disclosure, signage, receipt language, and the treatment of debit card transactions.
4. Statement Analysis and Savings Estimates
We may offer to review your existing payment processing statements at no charge and provide an analysis of your current costs along with available alternatives. The following applies to any such analysis:
It is an estimate. Our analysis is based on the statements and information you provide. We do not independently audit or verify that information, and we are not responsible for errors, omissions, or inaccuracies in materials supplied to us.
It is not a guarantee of savings. Actual costs depend on factors outside our control, including your transaction mix, card types presented, average ticket, processing method, chargeback and refund activity, interchange rate changes published by the card networks, assessments, and your own operational practices. Past or projected figures are not a promise of future results.
Interchange and network fees change. Visa, Mastercard, Discover, and American Express set interchange rates and assessments independently and revise them periodically. No party, including e-Flow, can fix or guarantee those costs.
Pricing is subject to underwriting. Any proposed rate or program is contingent on approval by the processor and its sponsoring bank, and may change based on the results of underwriting.
No obligation is created. Requesting or receiving an analysis does not obligate you to purchase anything, and does not obligate us to provide services.
5. Information You Submit to Us
The Site may offer a contact or inquiry form. When you submit information through the Site:
- You agree to provide accurate and current information.
- Do not submit sensitive information through the Site's forms. This includes full account numbers, card numbers, Social Security numbers, tax identification numbers, bank credentials, passwords, or complete processing statements. Our contact form is not a secure channel for that material. If we need documents from you, we will tell you how to send them.
- You grant us permission to use the information you submit to respond to your inquiry and to evaluate whether our services may be useful to you.
Our collection and handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
6. Consent to Be Contacted
By submitting your contact information through the Site, you agree that e-Flow Merchant Group and its processing partners may contact you at the telephone number and email address you provide — including by telephone call, text message, and email — regarding payment processing services and your inquiry.
You understand that such calls and messages may be placed using automated technology, that consent is not a condition of purchasing any goods or services, and that message and data rates may apply.
You may withdraw consent at any time. Reply STOP to any text message to stop texts, use the unsubscribe link in any email, or contact us using the information in Section 16.
7. Third-Party Services, Links, and Partners
The Site may reference, link to, or describe products and services offered by third parties, including payment processors, sponsoring banks, gateways, equipment manufacturers, and software platforms.
We do not control those third parties and are not responsible for their products, services, pricing, agreements, acts, or omissions. Your relationship with any such third party is governed solely by your agreement with them. References to a third party do not imply endorsement by that party of e-Flow, or by e-Flow of that party, except where expressly stated.
Disclosure of compensation: e-Flow may receive compensation, including commissions or ongoing residual payments, from processing partners in connection with merchant accounts we refer. This compensation does not increase the amount you pay beyond the pricing set out in your agreement with the processor.
8. Intellectual Property
The Site and its contents — including text, graphics, logos, trade names, layout, and design — are owned by e-Flow Merchant Group or its licensors and are protected by United States and international intellectual property laws.
You may view and print Site content for your own internal business evaluation. You may not reproduce, distribute, modify, republish, sell, or create derivative works from Site content without our prior written permission.
Third-party names, logos, and marks appearing on the Site are the property of their respective owners.
9. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms;
- Submit false, misleading, or fraudulent information;
- Attempt to gain unauthorized access to the Site, its servers, or any connected systems;
- Introduce malware, viruses, or other harmful code;
- Use automated means to scrape, harvest, or collect information from the Site;
- Interfere with the operation of the Site or with other users' access to it;
- Use the Site to transmit unsolicited commercial communications.
We may suspend or terminate your access to the Site at any time, without notice, for any reason.
10. Disclaimer of Warranties
THE SITE AND ALL CONTENT, MATERIALS, AND INFORMATION ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, E-FLOW DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that any content, estimate, or analysis is accurate, complete, or current.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, E-FLOW MERCHANT GROUP AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY INFORMATION OBTAINED THROUGH IT, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless e-Flow Merchant Group and its owners, members, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles.
Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may revise these Terms at any time by posting an updated version on the Site with a new "Last Updated" date. Changes take effect when posted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. Review these Terms periodically.
15. General
Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and e-Flow regarding the Site, and supersede any prior understandings regarding the Site. They do not govern any merchant processing agreement, which is a separate contract between you and the applicable processor.
Assignment. You may not assign these Terms. We may assign them without restriction.
