Privacy Policy
e-Flow Merchant Group
Effective Date: October 10, 2026
Last Updated: October 10, 2026
1. Introduction
e-Flow Merchant Group ("e-Flow," "we," "us," or "our") operates eflowmerchgroup.com (the "Site"). This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices available to you.
We are a payment processing sales and referral agency. We work with business owners, which means most of the information we handle is business information rather than consumer information. Where we do collect personal information, this Policy applies.
By using the Site or contacting us, you agree to the practices described here. This Policy is incorporated into our Terms of Use.
2. Information We Collect
Information you give us
When you submit our contact form, call us, or email us, we may collect:
- Name
- Business name
- Email address
- Telephone number
- Information about your business and its payment processing, including anything you choose to tell us about your current provider, volume, or costs
- Any other information you include in your message
Processing statements and business documents
If you ask us to review your payment processing costs, you may send us merchant processing statements or related business documents. These are typically exchanged by email or another method we arrange with you directly, not through the Site.
Please remove or redact sensitive data before sending. We do not need, and ask that you do not send, full bank account numbers, full card numbers, Social Security numbers, or login credentials. We need rate and fee detail, volume, and transaction counts — not account identifiers. If a statement you send us contains such information, we will handle it confidentially, but it is safer not to transmit it.
Information collected automatically
When you visit the Site, we and our analytics providers may automatically collect:
- IP address and general location derived from it
- Browser type and version, device type, and operating system
- Pages viewed, time spent, and links clicked
- The referring website or search term that brought you to us
- Date and time of your visit
This is collected through cookies and similar technologies, described in Section 6.
Information from third parties
We may receive information about you from our payment processing partners in connection with a merchant account application or an existing account we referred, and from publicly available business sources.
What we do not collect
We do not collect payment card numbers, bank account credentials, or Social Security numbers through the Site. We do not process or store cardholder data. We are not a payment processor and do not touch transaction flows.
3. How We Use Information
We use the information described above to:
- Respond to your inquiry and communicate with you
- Prepare the free cost analysis you request
- Evaluate whether our services and our partners' programs may fit your business
- Refer you to a payment processing partner, with your knowledge
- Send you information about our services, where you have consented to receive it
- Operate, maintain, analyze, and improve the Site
- Detect and prevent fraud, abuse, and security incidents
- Comply with legal obligations and enforce our agreements
We do not use your information to make automated decisions that produce legal or similarly significant effects about you.
4. How We Share Information
We share personal information only as described here.
Payment processing partners. If you ask us to prepare an analysis or pursue a merchant account, we share the information necessary to do so with our processing partners and their sponsoring financial institutions. Those parties handle your information under their own privacy policies and agreements with you. We will tell you who we are sharing your information with before we do.
Service providers. We use vendors who perform functions on our behalf — website hosting, email, analytics, customer relationship management, and document storage. They may access information only as needed to perform those functions.
Legal and protective disclosures. We may disclose information where required by law, subpoena, or legal process, or where we reasonably believe disclosure is necessary to protect our rights, your safety or the safety of others, or to investigate fraud.
Business transfers. If e-Flow is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction. We will give notice before your information becomes subject to a materially different privacy policy.
We do not sell your personal information
We do not sell personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined under Texas, California, and other state privacy laws. We have not done so in the preceding twelve months.
We do receive compensation from processing partners when a business we refer opens an account. That is a referral commission paid by the processor on a completed transaction, not a sale of your personal data.
5. Marketing and Communications
If you give us your contact information, we may contact you about payment processing services by phone, text message, and email.
You can opt out at any time. Reply STOP to any text message, use the unsubscribe link in any marketing email, or contact us using the details in Section 13. We will honor opt-out requests promptly.
Opting out of marketing does not stop communications necessary to a service you have requested or an account we are actively helping you open.
6. Cookies and Analytics
The Site uses cookies and similar technologies to function properly and to understand how visitors use it.
Essential cookies are necessary for the Site to work and cannot be turned off through our Site.
Analytics cookies help us understand traffic and usage patterns. We may use third-party analytics services, which set their own cookies and process data under their own privacy policies.
Most browsers let you refuse or delete cookies through their settings. Some parts of the Site may not function properly if you disable cookies.
Do Not Track. Browsers may send a "Do Not Track" signal. There is no industry-standard response to this signal, and the Site does not currently respond to it. We do, however, honor recognized opt-out preference signals where state law requires it.
7. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect information in our possession, including access controls, encrypted transmission where available, and limiting access to those who need it.
No method of transmission or storage is completely secure. We cannot guarantee absolute security, and you send information to us at your own risk. If we become aware of a security incident affecting your personal information, we will notify you as required by applicable law.
8. How Long We Keep Information
We keep personal information only as long as necessary for the purposes described in this Policy, including:
- Inquiries that do not become clients: generally up to two years from last contact
- Analyses and proposals: generally up to three years
- Client and referral records: for the duration of the relationship and as long afterward as needed for commission reconciliation, tax, and legal requirements
We may retain information longer where required by law or where necessary to resolve disputes or enforce agreements. You may request deletion as described in Section 9.
9. Your Privacy Rights
Depending on where you live, you may have the following rights regarding your personal information:
- Access — confirm whether we process your personal data and obtain a copy
- Correct — have inaccurate personal data corrected
- Delete — request deletion of personal data we hold about you
- Portability — obtain a copy in a portable, readily usable format
- Opt out — of the sale of personal data, targeted advertising, and profiling with legal or similarly significant effects (as noted in Section 4, we do not engage in these)
- Non-discrimination — we will not deny service, charge different prices, or provide a different quality of service because you exercised a privacy right
Residents of Texas
The Texas Data Privacy and Security Act grants Texas residents the rights listed above.
To exercise a right, contact us using Section 13 with your request and enough information for us to locate your records. We will respond within 45 days, and may extend once by an additional 45 days where reasonably necessary, with notice to you.
If we deny your request, you may appeal. Submit your appeal to the same contact, and we will respond within 60 days with our decision and reasoning. If we deny the appeal, we will provide instructions for submitting a complaint to the Texas Attorney General.
Residents of other states
Residents of California, Colorado, Connecticut, Virginia, and other states with comprehensive privacy laws have similar rights under their own statutes. We extend the rights described above to all U.S. residents who request them, regardless of whether a specific law applies to us.
Verification
We will take reasonable steps to verify your identity before acting on a request, and may ask for additional information to do so. An authorized agent may submit a request on your behalf with proof of authorization.
10. Children's Privacy
The Site is intended for business owners and is not directed to anyone under 18. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.
11. Third-Party Websites
The Site may link to websites we do not operate, including those of our processing partners. We are not responsible for the privacy practices of those sites. Review their privacy policies before providing information to them.
12. Changes to This Policy
We may update this Policy from time to time. We will post the revised version here with a new "Last Updated" date. If we make material changes to how we handle personal information, we will provide more prominent notice. Your continued use of the Site after changes are posted constitutes acceptance.
